Arbitration and Choice of Court Clauses: How do they measure up? Conference on June 8, 2023

On June 8, 2023, our colleague Patrick Ferland will give a conference entitled "Que valent vos clauses d'arbitrage et d'élection de for?”. Organized by the International Law Section of the Canadian Bar Association, Quebec Branch, this luncheon will be held at the firm's offices. There are still a few places left. Presentation of the conference:
Arbitration clauses are becoming increasingly common, and case law regarding their interpretation has evolved considerably. The same is true of choice of court clauses, as well as “choice of law” or “applicable law” clauses. What is the impact of these clauses, and how well do they manage to give effect to the parties' intentions?
This conference (in French) will address the main issues raised by these clauses, including their interpretation by the courts, the dos and don’ts regarding their drafting, the impact of their mandatory or exclusive nature, the possibility to waive their application, and their relevance when time comes to seek the recognition of an arbitral award or foreign decision before the Quebec courts. The issues covered will be of interest both to commercial lawyers called upon to draft or revise such clauses and to lawyers involved in litigation where the question of their applicability arises.
