Professional experience

Specialized in civil and commercial litigation, Jean handles a broad range of disputes related to contracts, real estate, and construction. He also has experience in obtaining and defending injunctions, seizures, and extraordinary remedies, such as Mareva (asset freeze) and Norwich (obtention of information) orders. His practice also extends to cases relating to the recognition of foreign judgments and arbitral awards.

Pragmatic and efficient, Jean acts before courts of all levels and his publications are frequently cited by Quebec tribunals.
Jean joined LCM Attorneys in 2022 after having worked for over nine years at one of Canada’s “seven-sister” law firm.

He has for several years been a member of the Board of Directors and Executive Committee of the Montreal Jewish Public Library and was during his studies the associate editor of the McGill Law Review.

Representative work

  • Acted for a developer in defence of multiple actions brought by the neighbour of a mixed-use development project in downtown Montreal. Instituted during the construction of the project, these proceedings included claims for the acquisition by prescription of a portion of land and for the recognition of a servitude, as well as a claim for the demolition of the building.

  • Acted for the owners of a shopping centre in defence to a claim brought by the owner of an adjacent vacant land who sought the annulment of a non-construction servitude and the payment of damages in the amount of $12 million.

  • Acted for various owners and tenants of commercial properties, including in relation to disputes to terminate leases, evict tenants, and obtain the payment of rent during the proceedings.

  • Acted for various sellers and purchasers of commercial properties in claims for transfer of title.

  • Acted for a large multi-national company in a construction litigation against the general contractor in the context of the redevelopment of a commercial property.

  • Acted for a major maple syrup producer and distributor in a construction claim relating to poor workmanship in the construction of a plant.

  • Acted for various general contractors, developers and owners in disputes relating to the construction of residential or mixed-use projects.

  • Acted for a foundation in an arbitration related to the termination of a service agreement and the cancellation of a fundraising event due to the Covid-19 pandemic.

  • Acted for a public company in injunctive proceedings in response to an unsolicited partial takeover bid made in breach of a confidentiality agreement.

  • Acted for a technology company in relation to unfair competition practices from a former business partner.

  • Acted for a leading fire alarm company in a dispute against a former shareholder who breached his non-competition, non-solicitation and non-disparage obligations.

  • Acted for an aeronautical manufacturing company in the defence of a multimillion-dollar claim relating to the reconfiguration of an aircraft.

  • Represented a major telecommunications company in its appeal of an administrative decision by the Commission d’accès à l’information du Québec prohibiting it from using personal information to perform credit checks and prevent fraud in connection with subscription to mobile telephone services.

  • Represented a fuel distributor in a multi-million dollar dispute over the interpretation of a number of laws and regulations relating to environmental law regimes.

  • Acted for an overseas bank in securing from the Quebec Superior Court the issuance of a worldwide freezing order of the assets of the debtor as well as the seizure before judgments of its assets located in Quebec.

  • Acted for an aircraft leasing company in obtaining a seizure before judgment of assets in the hands of a third party as well as the issuance of a Norwich-type order in connexion with the recognition of a multimillion-dollar foreign judgment.

  • Representation of a foreign creditor to obtain the recognition and enforcement of a decision rendered in the United Arab Emirates and to obtain the seizure before judgment of the debtor’s Quebec assets.

  • Acted for a mining company before the Supreme Court of Canada and the Quebec Court of Appeal in a matter involving the revocation of an order homologating an arbitral award as a result of an alleged conflict of interest of the arbitrator.

  • Acted for a European soccer club and its directors in defence of a claim from a Canadian investor. The claim was dismissed on the grounds that the Quebec courts should decline jurisdiction in favour of a more appropriate forum.
