Anaïs Kadian’s practice extends to many aspects of civil and commercial litigation. She represents clients in a variety of industries and areas of the law, including real estate litigation and construction law disputes, shareholder disputes, commercial litigation, estate and succession disputes, employment law and class actions. She regularly appears before judicial tribunals and has represented her clients before all levels of courts in Quebec.

Before joining LCM Attorneys Mtre Kadian worked as a lawyer in another boutique litigation firm in Montreal, also practicing in the areas of civil and commercial litigation and class actions. At the beginning of her career, she completed her articles and worked as a research attorney for the judges of the Superior Court of Quebec.

Mtre Kadian is very active in her community and has been a member of the Board of Directors of the Legal Information Clinic at McGill since 2010, in addition to being the Clinic’s Executive Director from 2010 to 2011.

She is also invited on an annual basis as a guest lecturer at McGill University’s Faculty of Law, as part of a class given by a judge of the Superior Court, training students on legal research and writing skills.

Representative work

Represented shareholders in the context of oppression proceedings.

Represented clients in cases involving breaches of commercial contracts and actions on account.

Represented clients in many types of real estate disputes, including action for conveyance of title, partition of an undivided property and claims for hidden defects.

Represented commercial and residential landlords in disputes concerning rental arrears, damages, eviction, lease termination, illegal subletting, and repossession of a dwelling.

Acted for non-profit organizations and housing cooperatives in landlord-tenant files, disputes concerning construction deficiencies and neighborhood disturbances.

Represented clients in copyright protection cases regarding the plagiarism of architectural works.

Represented a subcontractor against a general contractor in the context of construction hypothec proceedings.

Represented members of class actions in consumer law and competition law files.

Oversaw the implementation of a national marketing campaign ($1 million) for the distribution of funds to class action members and supervised fund distribution by claims administrator

Represented clients in unjust dismissal cases and claims relating to the exercise of stock options.

Represented heirs in a dispute over the capacity of the testator and the nullity of a will and a marriage, and in the context of an application for a safeguard order to appoint a provisional liquidator of the succession.

Represented a mandatary in the context of an application for the homologation of a protection mandate.
