PRIORITY TO SUPER-PRIORITY CHARGES – WHERE NECESSARY

The Supreme Court recently confirmed that in restructuring cases under the Companies' Creditors Arrangement Act, the courts can create super priority charges that have priority over a deemed trust created to secure a Crown debt, such as unpaid source deductions.
