LCM Attorneys successfully obtains two Norwich injunctions on the same day
9 November 2022
On November 7, two teams of lawyers from LCM Attorneys successfully argued motions for Norwich injunctions in two separate cases before the Quebec Superior Court, both in contexts where the firm's clients seem to have been the victims of fraud. In one of the cases, the Court also ordered third parties not to dispose of the defrauded assets in the interim. This type of order can have an extraterritorial effect, making it more efficient for the continuation of the proceedings.
A Norwich injunction is an exceptional remedy aimed at forcing a third party to disclose information that it alone possesses and that is essential to effectively undertake a legal recourse. The information obtained could, for example, allow to identify the operators of fraudulent financial transactions, to confirm the identity of bank account holders who have benefited from a fraud or to reveal the identity of an individual taking advantage of the anonymity offered by a website to make defamatory comments.
LCM Attorneys is proud to act in complex litigation cases, using its talent, experience and agility to find creative and effective solutions to the issues its clients face.
The attorneys involved in these cases are: Mtres Dominique Ménard, Marc-André Landry, Christophe Savoie, Joël Larouche and Sean Giacobbe.
