LCM Attorneys’ Supreme Court victory named one of Lexpert’s Top 10 Decisions

An important victory obtained by LCM Attorneys before the Supreme Court of Canada – Resolute FP Canada Inc. v. Hydro-Québec, 2020 SCC 43 – has just been recognized by Lexpert magazine as one of the 10 most important business decisions of 2020-2021.
The firm represented Hydro-Québec in the context of a dispute against a major forest products company regarding Hydro-Québec's right to impose the payment of amounts to be paid to the Generations Fund established by the Québec government. The dispute, which was based on the interpretation of a 1926 contract signed by an electricity company now owned by Hydro-Québec, gave the Supreme Court an opportunity to rule for the first time on the legal framework applicable to the assignment of contracts in Québec law.
The Supreme Court recognized that a contract can be considered a patrimonial asset that may be subject to assignment – a novelty under Quebec law – and set out the conditions under which such an assignment may be set up against the other party to the contract.
