Professional experience
Alberto has a diverse practice of litigation and dispute resolution in civil and commercial matters. He also assists his clients in the negotiation and drafting of commercial agreements, including shareholder agreements and commercial leases. He combines rigorous legal analysis, a practical and strategic approach to issues, and the tact needed to navigate a wide range of conflict situations.
Alberto has acted in a number of areas of the law, including commercial and contractual disputes, banking matters, manufacturer’s and seller’s liability claims, libel proceedings, disputes relating to matters of public law and defence of class actions. He knows how to focus on the interest of his clients, both in litigious and business contexts, and approaches problems with this in mind. Alberto’s clients seek his advice regularly with respect to their operations.
Over the course of his career, Alberto has conducted several workplace investigations in relation to the implementation of harassment policies, including psychological harassment. He has also advised academic disciplinary committees to ensure procedural fairness in their work, has provided training on academic discipline, and has assisted a university in the development and review of its internal policies.
Alberto was a lecturer at the Faculty of Law at the University of Montreal, where he taught law on obligations.
During his university studies, Alberto completed the Canadian Securities Course (CSC), worked in the securities sector of BCE Inc., and articled with the Honourable André Rochon, then a justice at the Court of Appeal of Quebec.
After articling for admission to the Bar with a leading national firm, Alberto practised in a well-respected boutique firm, of which he became vice-president in 2012, prior to joining LCM Attorneys.

Representation of financial institutions in various disputes involving routine banking transactions, fees relating to financial products, refusal of financing, payment in error, loss of bank draft, falsified or altered cheques, Payments Canada rules, unauthorized withdrawals, fraud and termination of banking relationship.

Representation of landlords and tenants in commercial leasing matters, and advice in drafting and publishing commercial leases.

Representation of a manufacturer of electrical power transformers in connection with a hidden defect claim of approximately $100M.

Represented a landowner in obtaining an interim injunction ordering measures to protect his building from debris from a high-rise construction site.

Representation of a creditor for the purpose of obtaining an emergency order suspending the sale of their bankrupt debtor’s assets by the trustee as a result of the bankrupt’s withholding of information in disclosing their assets.

Represented the Attorney General of Canada, a former Prime Minister and a Federal Minister before the Court of Appeal in the context of a claim for damages instituted by a former ambassador following his recall.

Representation of financial institutions in defence of class actions relating to conversion fees imposed on credit card transactions in foreign currencies and penalties imposed on mortgage prepayments.

Representation of a shareholder challenging his dismissal as an employee of a corporation in the context of an arbitration raising the issue of a consensual arbitrator’s right to rule on an oppression remedy within the meaning of the CBCA.

Representation of a real estate developer in a defamation action against a newspaper alleging breaches of journalistic standards.

Representation of a syndicate of co-owners in connection with a claim for loss of the building following the collapse of a rock face caused by building construction in the mountains.

Representation of the Attorney General of Quebec in an application for an injunction to prohibit the construction of a private aerodrome in wetlands and water and in a debate on the constitutional applicability of environmental protection laws matters under federal jurisdiction.
